 This Invitation to Tender follows the General Procurement Notice dated 27.04.2026 for the project "Installation of Individual Heat Substations and Energy Efficiency Improvement — Mykolaiv", published on the NEFCO website under the Procurement Notices section ((https://www.nefco.int).

Regional Utility Company “Mykolaivoblteploenerho” (hereinafter the “Employer”) intends to use grant funds provided by the Government of Denmark through the Danish Ministry of Foreign Affairs (hereinafter “DMFA”), through the development partner — the Nordic Environment Finance Corporation (NEFCO), as manager of the NEFCO Green Recovery Fund for Ukraine, as well as local co-financing funds, to cover costs under the project "Installation of Individual Heat Substations and Energy Efficiency Improvement — Mykolaiv".

The Employer hereby invites Contractors to submit their tenders electronically for the award of contract(s) MYK_DH_1 Installation of Individual Heat Substations and Energy Efficiency Improvement — Mykolaiv (hereinafter the “Contract”), including:

 

Lot 1: Installation of individual heat substations for the boiler house heating district located at 71 Bila Street;

Lot 2: Installation of individual heat substations for the boiler house heating district located at 42 Samoilovycha Street;

Lot 3: Reconstruction of sections of the heating networks of the boiler house heating districts located at 71 Bila Street and 42 Samoilovycha Street;

 

to be financed from the contribution of the Government of Denmark through the DMFA in the form of a grant (hereinafter “Danish Support for Ukrainian Municipalities”) to the NEFCO Green Recovery Fund for Ukraine (hereinafter “Green Recovery Fund”), as well as from local co-financing funds (budgetary funds).

 

The tender and subsequent Contract(s) financed from grant and budgetary funds shall be governed by NEFCO's Procurement Policy and Procedures.

 

Grant and budgetary funds may not be used for any payments to persons or organizations, or for any import of goods, if such payment or import is prohibited by a resolution of the UN Security Council adopted under Chapter VII of the Charter of the United Nations, or under the law or official regulations of Ukraine.

 

Tenders may be submitted for one, two, or all lots. Evaluation of tenders shall be carried out separately for each Lot. Contract award may be made per each Lot separately or for several Lots to one Tenderer, depending on the results of the comprehensive evaluation of tender offers.

 

Following the tender, separate contracts shall be concluded with the successful Tenderer(s) depending on the funding sources:

 

— for Lots 1 and 2, one contract shall be concluded (in case of contract award for these Lots to different Tenderers — one contract per each awarded Tenderer), financed exclusively from Danish MFA grant funds through NEFCO, in euros excluding VAT;

 

— for Lot 3, two contracts shall be concluded, according to the funding sources:

(i) a contract financed from grant funds, in euros excluding VAT; (ii) a contract whose value will represent approximately 12% of the Bidder's tender price, financed from city budget and/or Contracting Authority funds, in UAH including VAT.

 

The Contract(s) financed from grant funds provided by the Government of Denmark through the DMFA shall be concluded in euro and shall be subject to the tax exemption procedure in accordance with Resolution of the Cabinet of Ministers of Ukraine No. 153 of 15.02.2002.

 

The contract financed from local budget funds shall be concluded in hryvnias according to the euro equivalent at the official exchange rate of the National Bank of Ukraine established on the date of signature of the notification of contract award to the successful Tenderer (including VAT).

 

To be eligible for contract award, Tenderers’ must meet the following minimum requirements:

 

— Tenderers must satisfy the eligibility criteria set out in Clause 4 of the Instructions to Tenders (ITT), in particular: have no conflict of interest, not have been declared ineligible, and not be excluded from participation in NEFCO tenders for the period of contract conclusion.

 

— The Tenderer shall demonstrate that the average annual turnover over the last three years (2023–2025) exceeds:

For Lot 1 — EUR 3,000,000 equivalent

For Lot 2 — EUR 2,000,000 equivalent

For Lot 3 — EUR 2,000,000 equivalent

 

In case the tender is submitted by a JVCA (Joint Venture, Consortium, Association), all members/partners of the JVCA shall demonstrate 100% compliance with this criterion, with the leading partner demonstrating at least 50% compliance.

 

— The Tenderer shall demonstrate access to financial resources to ensure working capital in an amount of no less than 40% of the Tenderer's tender price, taking into account the Tenderer's commitments under other concluded contracts and/or contracts to be concluded. In case the tender is submitted by a JVCA, all JVCA members/partners must collectively demonstrate 100% compliance with this criterion, with the leading partner demonstrating at least 50% compliance;

 

— The Tenderer shall demonstrate that during the period 2020–2025 they have successfully completed:

 

For Lot 1 — four (4) contracts with a total value of no less than EUR 3,000,000, successfully completed and which included experience in modernization/installation of heat supply systems; among them at least one (1) contract for the installation of individual heat substations (IHS);

 

For Lot 2 — four (4) contracts with a total value of no less than EUR 2,000,000, successfully completed and which included experience in modernization/installation of heat supply systems; among them at least one (1) contract for the installation of individual heat substations (IHS);

 

For Lot 3 — three (3) contracts with a total value of no less than EUR 2,000,000, successfully completed which included experience in construction, reconstruction, or replacement of external engineering networks; among them at least one (1) contract for construction, reconstruction, or replacement of heat networks.

 

— No contract non-performance by the Bidder (including partners/members if the Bidder is a JV) shall have occurred within the last three years (2023–2025) based on information provided in Section III “Tender Forms” (the Contracting Authority reserves the right to verify the accuracy of the reported information using other sources);

 

— All pending litigation against the Tenderer (including partners/members if the Tenderer is a JVCA) shall in aggregate not exceed 30% of the Tenderer's net worth;

 

— The Tenderer must demonstrate that it (a single legal entity, or a JVCA partner/member, or the relevant Subcontractor) has all personnel available to carry out the work included in the contract;

 

— The Tenderer must demonstrate that it has personnel for key positions meeting the Qualification Requirements set out in the Tender Documentation.

 

When preparing the tenders, Tenderers shall take into account that works under this Contract are expected to commence in September 2026 and must be completed no later than December 2028.

 

The Tender Documentation may be obtained free of charge from the Tender Agent upon receipt of a written request from a potential Tenderer sent by e-mail to: [email protected].

 

Tenders must be submitted electronically before the submission deadline; otherwise, they will be rejected. Tender documentation must be submitted in PDF format, and Price Schedules — in PDF and MS Excel formats.

 

Electronic submission of tenders shall comply with the following conditions, otherwise the tender may be rejected:

 

— The complete tender shall be submitted in one, or the minimum possible number of e-mails, each no larger than 10 MB, with the subject line: “Tender _MYK_DH_1_[company name]_Tender Part X of Y”;

 

— The e-mailed tender shall be submitted in .RAR or .ZIP format, with the file (archive) containing the Letter of Tender submitted as a separate password-protected archive named “Tender_MYK_DH_1_[company name]_Letter of Tender”;

 

— All files (archives) must be protected with a single password;

 

— The password for the tender offer files must be sent in a separate e-mail to NEFCO representative’s email: [email protected] no later than the tender submission deadline, with the subject line “Tender _MYK_DH_1_[company name]_Password”.

 

The Tender Committee reserves the right to reject a tender submitted in non-compliance with the above requirements if such non-compliance is material and affects the confidentiality, integrity, or ability to properly review the offer.

 

Tenderers shall submit with their tender a Tender Security Declaration using the relevant form included in Section III “Tender Forms”. Any tender not accompanied by a Tender Security Declaration will be rejected by the Contracting Authority as non-compliant.

 

The Contracting Authority reserves the right to cancel the tender in the event that grant financing approval is not received.

In addition, a pre-tender meeting between Tenderers and representatives of the Employer will be held via video conference on 06.07.2026 at 14:00 (Kyiv time) to discuss technical and procedural matters. To register for the pre-tender meeting, please send an e-mail to [email protected] with a registration request and the Tenderer's contact information, including: company name, full name of the company representative, and position. The link to join the pre-tender meeting will be sent one day before the event.
